You have the right to be told about Disability Rights Texas for both inpatient and outpatient care.  They are a federally required agency, independent of DADS and DSHS.  Their purpose is to protect and to speak up for your rights.

 

If you are Medicaid eligible and service coordination or rehabilitative services are denied or terminated, you have the right to appeal the decision. You can appeal the decision through the rights officer or you may request a fair hearing by writing to DADS or DSHS Medicaid Administration office contract with the Department of Human Services.   Call the rights officer for details.

If you believe that you have been abused or neglected, you should report this to:

Coastal Plains Community Center  Rights of People Served

This is a summary of the rights that people have who receive services from Coastal Plains Community Center.  If you would like a detailed list of your rights, please ask your service coordinator or the front desk for a complete rights handbook.  This is not a comprehensive list of your rights and is not intended to grant or deny any right guaranteed by law.

● Your first right is the right to choose services.  Unless you are ordered by a court of law, or have a legal guardian, you have the right to accept or refuse services.   In other words, we cannot make you get services here.  Note:  If a doctor believes that you present a danger to yourself, others, or there is a risk of this happening if you do not get services, you may be detained in the hospital for up to 24 hours to be evaluated (emergency detention).  You also have the right to a hearing (due process) before restriction of rights.

 

● Rights Citizens of the United States of America.  These include, but are not limited to:  the right to impartial access to treatment, regardless of race, nationality, religion, gender, ethnicity, sexual orientation, age or disability; the right to vote; practice a religion; get married; to sue and be sued; and other rights unless a judge has taken away these rights.

 

● Right to be informed of your rights.  Before you agree to accept voluntary services or upon admission to involuntary services, you must receive a copy of your rights.  You must also be informed of your rights in a language you understand (English, Spanish, Sign Language, Braille, or other forms of communication that may be appropriate).

 

MORE RIGHTS AS A CONSUMER OF SERVICES:

 

● Consent to treatment – You cannot be forced to receive services at the Center unless you are ordered by a judge.

● Treatment in the least restrictive setting – The Center provides outpatient services, services that are available to all with a diagnosis that meets service criteria.   All attempts will be made to prevent hospitalization.

● Recovery Treatment planning – This is your plan developed by you and staff to help you identify your goals regarding treatment and what the center can do to help you meet your goals. Participation in the recovery plan process is essential in obtaining services to help you meet your recovery goals.

● Confidentiality – Your records and any information about you is private and will not be shared with people outside of your treatment team without your consent.

● Revoking of consent – You can tell us, at any time, that you do not want services any more, or you can tell us that you do not want us to talk to certain people anymore.

● Access to your record – You may have access to your records, though this access may be limited by a doctor if he/she determines the information might be harmful to you.

Information about hospitalization will be provided to you, if this occurs.

You have additional rights if you are hospitalized  (voluntarily or involuntarily).

YOUR RESPONSIBILITIES

● Keep appointments and be on time.

● Call in advance (preferably 24 hours in advance) to cancel appointments if you cannot make the appointment.

● Pay the designated fee for the service based on ability to pay scale.

● Participate in development of goals and objectives, and follow your plan, such as…

   Take medications as prescribed

   Attend meetings, classes, or groups that you are scheduled for

   Learn the skills being taught to you on your plan, etc.

● Stay in contact with your service providers (case manager, nurse, service coordinator).

● Let staff involved in your treatment know what is going on in your life that may affect treatment

   Tell staff about…any problems with medications  or any changes in behaviors or mood , problems/issues with yourself or your family that are       upsetting such as deaths, accidents, moving, loss of job, illnesses.

● Treat others with respect and dignity

● In order to ensure the safety of everyone please, do not carry a weapon (knife, handgun, etc) or be under the influence of drugs or alcohol    while on Center property.

● Good working relationships are based upon respect.  Please respect others while at our clinic, both staff and other people served.  How? Use your manners, dress appropriately, please do not curse or use foul language, and maintain confidentiality of others.
